Should any discrepancy occur between the English and German version of the document the German version shall prevail

In the following terms and conditions, the Hotel Bernerhof is mentioned with the legal name of the Simple Company Hotel Bernerhof Interlaken KLG (hereinafter referred to as HB).

1. Scope

These terms and conditions apply to all legal relationships between HB and the guest.

2. Conclusion of contract

With the receipt of the written, telephone, electronic or personal booking and the delivery of our confirmation, a contract is concluded between the guest and HB. The present general terms and conditions are part of this contract. Notifications by email are considered to have been made in writing. At least one accompanying person must be of legal age to conclude the contract (18). Age is checked at check-in.

3. Booking conditions

For all bookings that are not made via the Internet, the confirmation form provided by us must be signed and the credit card details must be disclosed as a guarantee. If these conditions are not met, HB can cancel the booking without notification. Clause applies to the cancellation costs. 5 below.

4. Price changes

EGHB can change the advertised prices in the following cases:

newly introduced or increased state taxes (e.g. value added tax, visitor's tax, etc.) Exchange rate changes (will be converted according to the current daily exchange rate) misprints that can be clearly explained

5. Cancellations and rebookings
5.1 General conditions

Cancellations or rebookings are only valid if they are sent to HB in writing or by telephone. The following costs arise:

Hotel reservations by individuals

Bookings can be canceled free of charge up to 72 hours before arrival (4 p.m.). Cancellations after this time will be charged the cost of 1 night. For stays of several days, the first two nights will be charged.

Non-refundable bookings will not be refunded (except in the event of force majeure). COVID-19 is no longer considered a case of force majeure.

5.2 Date of cancellation and insurance

The decisive factor in calculating the cancellation date is the receipt of the written or telephone declaration at the hotel.
In the event of hardship, the cancellation costs will be covered by a cancellation insurance, provided the guest has taken out one.

5.3 Cancellation in the event of force majeure

In the event of force majeure such as political unrest, strikes, catastrophes, etc. For security reasons, HB can also cancel at short notice. In such cases, the guest will get back any paid amount in the form of a voucher.

5.4 Malfunctions and operational restrictions

Disorders such as Noise and / or operational restrictions do not entitle to compensation or reimbursement.

6. Obligation to pay compensation and liability

EGHB is only liable for damage in cases of intention or gross negligence. Liability for items brought in by the guest is excluded to the extent permitted by law.
Claims must be made to HB in writing immediately, at the latest 5 days after departure; otherwise, the claims are considered to be forfeited.

7. Use of hotel rooms

The guest must use and treat the hotel room with the greatest care. It may only be used by the number of people (including children) specified in the contract. The guest is not permitted to let hotel rooms rented from HB to third parties for use.
The guest is liable for any damage unless he can prove that it was caused through no fault of his own (or that of co-users). Damages must be reported immediately. Pets are not allowed in the hotel.

8. Data protection

EGHB undertakes to observe the applicable data protection legislation when handling and processing all customer data and customer usage data. Customer data is only used to maximize operational security or in the interest of sales promotion, product design, crime prevention, collection of key economic data and statistics, and billing. 

The guest hereby acknowledges and agrees that in the event of joint provision of services in cooperation with third parties, HB is entitled to make the relevant third party accessible to the third party concerned to the extent that this is necessary in the interest of rendering the services. In addition, the disclosure of customer data to third parties is only permitted with the express consent of the customer. An exception only applies if HB is legally obliged to pass on personal data to third parties. More information can be found here.

9. Applicable law and place of jurisdiction

Swiss law is exclusively applicable to all contracts concluded with the HB under these terms and conditions. The exclusive place of jurisdiction for any disputes arising from such contracts is Interlaken.
